Creative Sailing Corp. is a company registered in the USA since 1991. From the many years of experiences dating back to 1965, we are proud that we can offer our customers an ultimate excursion to natural habitats untouched islands by tourism and make a trip that may make a difference in their lives. Traveling frequency has increased manifolds over the past decade and sailing cruises are no longer limited to domestic waters. In fact, chartering boats has become available all around this globe. Also it is no longer that old boat where one had to do more repairs to keep it going, charter companies do bring continuously brand new boats into their fleets. The company specializes in individual cruises based on local knowledge of a territory. Bareboat charters need about 3 trips to an area, before they learn on where to go, where to snorkel, what to see and where to eat. Creative Sailing has sailed in all these areas extensively, has local knowledge and can make suggestions, plan itineraries and make your trip as comfortable as possible. For people who emphasize on the sailing part, they can broaden their knowledge in cruising offshore, do practical navigation and learn to share the waterways with large commercial traffic. All this adds to a person’s many experiences to a sailing career.

General Conditions:

The prices quoted and agreed upon are per person and do not include airfare. Running expenses like fuel, mooring fees, cruising permit, end cleaning, customs and immigration fees, insurance deductible and provisioning are additional, unless clearly specified in the charter contract.

Personal Liability.

Each participant (incl. skipper) does agree not to apply a claim under each other with the exception to a great negligence of an individual. The liability shall not exceed the coverage of a personal liability insurance policy. In case of any damage to the chartered equipment, each participant shares the costs equally to the max. deductible amount of the insurance covered by the charter company. This does not apply in the case when Creative Sailing Corp. is including a non-refundable security deposit. In such a case, all the equipment is covered under the insurance, except the dinghy and outboard motor. Each participant has to be aware that a sailing trip of this nature has higher risks. With discipline, the chances that something will happen can be reduced to a minimum. Safety comes first and each crewmember will be informed about safety gear on board and precautions to be taken in a case of an emergency. Going offshore for approx. 120 nautical miles in some instances requires, that each participant is a swimmer or that an individual is wearing a swim west all the time. Creative Sailing Corp. does not carry any liability for personal injury or death of a participant, but is solely liable in connection of delivering a boat in time according to the stipulations and conditions of a particular charter company. A liability waiver has to be signed by each participant prior to the departure of a trip.

Cancellation Policy.

To understand this policy, it is important to know that Creative Sailing Corp. has committed to a particular boat for a specific price at the time of the reservation. This is a contract that can not be cancelled, unless all the installments will be lost. If for some unforeseen reasons a participant is not able to make the trip, Creative Sailing Corp. is applying the same policy and all the installments of a participant would be non-refundable, unless another person can fill the place. In such a situation, the paid installments would be refundable less the cancellation fee. The cancellation fee is 10% of the total amount due. Leaving the boat earlier, or participating only partially, will give the participant no right to get a refund, unless Creative Sailing Corp. has agreed to such a variance before the departure, or when a particular contract allows such an action. For the case of non-compliance to the contract for medical reasons, we recommend that each participant cover himself for such an incident with a personal insurance. Travel agents can include such insurance to your flight arrangements at reasonable costs.

Possession of illegal Drugs, accidental death and injury.

The use and being in possession of illegal drugs during the trip, organized by Creative Sailing Corp., is strictly prohibited. In case of non-compliance to this regulation, it will make an individual fully responsible for any consequences it may have. (For informational purposes, officials for example can confiscate a boat, if any illegal drug can be found on board of a yacht. The same applies to possess any kind of weapons.

The use of alcohol may increase the risk of injury around water and boats. Creative Sailing Corp. can not be held responsible for such an incident. Creative Sailing Corp. in general shall be held harmless from any and all claims or liability of personal injury or death during a scheduled trip. See under personal liability.

Seasickness

A not too famous chapter. Everybody can be affected, but the human body also does adjust within a few days to the irregular movements of a boat. For this reason Creative Sailing Corp. tries to plan itineraries in such a way that the body will have a chance to adjust to the boat’s motions. There is also good prevention medication available and each participant should know what works best for his or her personal requirements. In case of doubt, consult your personal physician before the trip.

Skin Diving, Swimming and use of Dinghy.

Creative Sailing Corp. shall not be held liable for accidents, injuries or death due to swimming, windsurfing, or the use of snorkel, masks and allied equipment such a scuba gear, sailboards and dinghies.
